The present petition has been filed under Article 226 of the Constitution of India, 1950 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter, ‘BNSS’) seeking quashing of FIR No.793/2006 under Sections 420/467/468/471/511/120B of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) registered at Police Station Malviya Nagar, datedThis is a digitally signed order.

Learned counsel for the petitioner submits that the complainant is the uncle of the petitioner, and that the dispute is essentially civil in nature, arising out of a family/property dispute between the parties, which had already been the subject matter of a compromise decree passed by the learned Civil Judge, Pili Banga, District Hanumangarh, Rajasthan, on 12.12.1996.

Learned counsel for the petitioner further submits that the police initially filed a closure report in the year 2018; however, upon the complainant filing a protest petition, the same was allowed. Thereafter, a supplementary charge-sheet came to be filed in the year 2025, i.e., after a lapse of more than seven years.
