CORAM: HON’BLE MR. JUSTICE PRATEEK JALAN O R D E R % 23.09.2026 1. The petitioner has filed this petition under Article 226 of the Constitution, against an order dated 23.05.2022, by which respondent No.1 - Container Corporation of India Limited [“CONCOR”] fixed his pay.

2. The petitioner joined CONCOR on 01.12.2017, prior to which he was serving in the Indian Railways as an Assistant Loco Pilot/Loco Pilot (Passenger) since 18.06.1996.

The petitioner’s grievance is that while granting him pay protection, CONCOR only took account of the basic pay he was drawing in Indian Railways and not the 30% “running allowance”, to which he was otherwise entitled.This is a digitally signed order. After some arguments, Ms. Sonika, learned counsel for the petitioner, submits that the petitioner does not wish to press this petition, but seeks an opportunity to approach CONCOR with a comprehensive representation for reconsideration of the impugned decision.

4. The petition is dismissed as withdrawn, in terms of the aforesaid submissions.

5. It is made clear that this Court has not entered into the merits of the controversy, and it is open to CONCOR to consider the petitioner’s representation and take a decision either way, in accordance with law.
