2. Application stands disposed of. W.P.(C) 13711/2026 3. By way of the present writ petition, the petitioner is seeking following prayers: “A. Issue a writ of Certiorari quashing the Impugned Letters dated 1.4.2026 issued by the respondent DPCC imposing environmental compensation of Rs. 4.2 lakh for period Cctober 2022- September 2025 on the basis of show cause notice dated 10.12.2025.

B. To direct the respondent only to consider the designed parameters for consideration of efficacy of the CETP underThis is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 19/09/2026 at 17:38:00 consideration. C. To direct the respondent to take the steps for upgradation of the CETP Jhilmil with financial and technical support to the petitioner.

D. To direct the respondent to take the action against the individual or industry those are generating BOD and other trade effluent in violation of Inlet Standards to CETP, E. To direct the respondent not to consider the parameters for analysis of treated water from the CETP Jhilmil those are not within the designed parameters of the CETP Jhilmil. F. To direct the respondent not to take the formula of CPCB as sole basis for calculation of Environment compensation, instead to take in to consideration the actual damage to environment assessed by the expert institution so notifies by the CPCB.

G. To direct the respondent to dispensed with the monthly sampling of treated water from the CETP Jhilmil in view of the installation of Online Monitoring System as the same is giving the real time data to the server of the CPCB and DPCC/respondent, H. To direct the respondent to stop the diversion of the sewage waste of JJ cluster, Metro Stations, Banks, and other commercial establishment in view of the conditions of 4 party agreement dated 20-07-2005 till modification of the CETP.” 4.

Issue notice. The learned counsel appearing for the respondent accepts notice.

5. Let counter-affidavit/reply, if any, be filed within three weeks from date, with an advance copy to the learned counsel for the petitioner, who may file rejoinder thereto within two weeks thereafter.
