Quash and set aside the Surviving Member Certificate No. 90660000271582 dated 19.03.2025 issued in favour of Respondent No. 6; b. Issue a writ of mandamus or any other appropriate writ/order directing Respondent No. 4– Unique Identification Authority of India (UIDAI)– to conduct a thorough verification and to suspend, cancel and deactivate the Aadhaar number/card fraudulently obtained and used by Respondent No. 6 for securing the impugned Surviving Member Certificate, and to initiate prosecution under the applicable laws. c.

Direct the competent authorities to take appropriate steps to investigate the fraudulent procurement of the certificate; d. Grant such other and further reliefs as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.” 2. Pass a Decree of Permanent Injunction restraining Defendant No. 1, her agents, associates, or any person acting on her behalf, from using, presenting, relying upon, or in any manner deriving benefit from the Surviving Member Certificate bearing No. 90660000271582 dated 19.03.2025, issued by the office of Defendant No. 2, in any legal, administrative, financial, or private proceeding, as the same has been obtained through fraudulent misrepresentation and without legal basis; b.

Pass a Decree of Mandatory Injunction directing Defendant No. 2, the Tehsildar/SDM of Saraswati Vihar, North-West Delhi, or any other competent authority under their jurisdiction, to forthwith revoke, cancel, and declare as null and void the aforesaid Surviving Member Certificate dated 19.03.2025, issued in favor of Defendant No. l, as the same was procured by means of false identity, forged documentation, and suppression of material facts, without conducting any lawful verification or notice to the rightful @ heirs; c.

Pass a Decree of Declaration declaring that the Surviving Member Certificate No. 90660000271582 dated 19.03.2025 is fraudulent, illegal, and void ab initio, having been obtained through deliberate impersonation, submission of false and fabricated documents, and misrepresentation of marital status by Defendant No. 1, and therefore, not legally enforceable against the estate of the deceased Late Sh. Akash Gupta;” 3.

Pertinently, the civil suit was filed by the petitioner on 07.05.2025 and is still stated to be pending. The petitioner, in such circumstances, cannot maintain the present writ petition seeking similar reliefs as are sought by him in the civil suit which is still pending adjudication.

4. Insofar as the prayer pertaining to a representation given to the Unique Identification Authority of India for initiating steps for the alleged fraudulent procurement of a certificate is concerned, the authorities are expected to take appropriate steps in accordance with law.
